Privacy Policy

1. TERMS

1.1. Data Recipient – a legal or natural person to whom personal data about the User (as defined below), including companies related to digioptima.eu (parent, subsidiary companies), partners with whom digioptima.eu (as defined below) cooperates to provide Users with the opportunity to use the Website;

1.2. Personal Data – any information relating to a natural person – a data subject, whose identity is known or can be directly or indirectly determined using such data as personal identification number, one or several physical, physiological, psychological, economic, cultural, or social characteristics;

1.3. Items – goods of any kind that are not exempt from circulation under the laws of the Republic of Lithuania, which the User uploads to the relevant Website catalog to sell, exchange, or make another Transaction for non-commercial purposes, or simply for informational purposes;

1.4. Information Society Services – services provided at a distance by electronic means and at the individual request of a recipient of services, usually for a fee;

1.5. IP Address – a unique number identifying a computer, phone, tablet, or other device connecting to the internet. The IP address can be used to identify the country where the computer is connected to the internet;

1.6. Browser – a program that helps access websites on the internet, on a personal computer or phone;

1.7. Account – the result of the User’s registration on the Website, resulting in the creation of a User profile that stores his personal data and usage of the Website’s services;

1.8. Privacy Policy – this document, which sets out the main rules for the collection, storage, processing, and storage of Personal Data applied to Users using the Website;

1.9. Cookies – small files uploaded to the User’s computer, phone, tablet, or other used device when the User visits the Website, which help the Website recognize the User’s device. This term includes not only cookies but also the use of similar tools (e.g., Flash cookies);

1.13. Direct Marketing – all activities that enable the Website administrator to offer services or convey any other messages to the User by mail, phone, or other direct means, aiming to inform the User or to obtain a response from him, and all related services.

1.14. User – every natural person using the Website, regardless of whether they are a registered user or use the Website without registering;

2. GENERAL PROVISIONS

2.1. This privacy policy regulates the main principles and procedures for the collection, processing, and storage of the Website User’s personal data.

2.2. The collection, processing, and storage of the User’s personal data are determined by this Privacy Policy, and to the extent that it is not regulated – by the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts.

2.3. By providing their Personal Data on the Website, Users agree that digioptima.eu will manage and process them for the purposes, means, and order specified in this Privacy Policy and legal acts.

2.4. Users are considered to be acquainted with this Privacy Policy when they register on the Website.

2.5. The Privacy Policy can be reviewed repeatedly at any time on the Website.

2.6. This Privacy Policy automatically applies to Users who use the Website without registering, as far as allowed by the general rules of the Website.

3. USE OF COOKIES

3.1. Cookies are used on the Website.

3.2. Cookies help improve the operation of the Website, adapting its content to the User’s needs.

3.3. By using the Website, you agree to the use of the above-mentioned Cookies on the Website.

3.4. In the browser settings, you can delete or block Cookies or part of them, but in this case, part of the Website may not work.

4. COLLECTION, STORAGE, USE OF PERSONAL DATA

4.1. Individuals wishing to register on the Website must provide their email address, chosen User name, and password. An Account is created during registration, where the User can specify additional Personal Data, such as name, surname, date of birth, gender, city (place of residence), etc. The User can edit, supplement, or delete his Account with all its data at any time.

4.2. The User’s address and/or computer IP address provided in the Account may be used to determine the User’s location. The Website Administrator may receive information from the User’s mobile device to determine the User’s location only with the User’s prior consent.

4.3. Digioptima.eu collects, stores, and processes any Personal Data provided by the User in the Account and obtained while using the Website for the following purposes:

4.3.1. To provide Users with the opportunity to use the Website.

4.3.2. For the efficient provision of services offered on the Website. Digioptima.eu ensures that the use of the Website is efficient and that identity theft, fraud, and/or dishonest behavior can be avoided.

4.3.3. To ensure continuous improvement and development of the Website, digioptima.eu has the right to use Personal Data for its services’ Direct Marketing purposes, when the User does not object and expresses his consent.

4.4. If the User agrees to allow the use of his Personal Data for Direct Marketing purposes, he marks the relevant boxes in the “My settings” section of the Account window, under “Privacy settings”, in the “Email notifications” section. The User can inform digioptima.eu at any time that he withdraws his non-objection/consent to use his data for digioptima.eu services’ Direct Marketing purposes. In this case, the User is immediately removed from the Direct Marketing notifications recipient database.

4.4.1. Administering the Website and diagnosing possible malfunctions, the Website Administrator may also use the Users’ IP addresses.

4.5. Digioptima.eu stores Users’ Personal Data for 3 (three) months from the deletion of the Account on the Website or for 3 (three) years from the last User’s login to the Account on the Website, except in cases provided for in the Privacy Policy, digioptima.eu general rules, or legal acts, where Personal Data may be stored for a longer period.

5. WEBSITE LINKS

5.1. Digioptima.eu Website links are links to certain websites where the same information as on the Website may be hosted, as digioptima.eu is both the controller of the Website and the Website links.

5.2. Users of the Website links are subject to the Privacy Policy of the web page where the digioptima.eu Website link is located, the rules of that page, as well as this Privacy Policy and other rules applicable to digioptima.eu published on the Website.

5.3. Digioptima.eu has Website links on the following web pages: Facebook, LinkedIn, Youtube, and other social networks.

5.4. The User agrees that photos of Items uploaded by the User in the Website links may be used for marketing purposes.

6. PROVISION OF PERSONAL DATA

6.1. Digioptima.eu informs that it does not transfer, either for a fee or free of charge, or otherwise disclose Personal Data to third parties, both within the territory of the Republic of Lithuania and in European Union countries and other foreign countries, except in the cases listed below:

6.1.1. if the User’s consent to disclose his Personal Data is obtained;

6.1.2. to Personal Data recipients – to implement the purposes specified in this Privacy Policy;

6.1.3. to law enforcement institutions – in the manner prescribed by the laws of the Republic of Lithuania; 6.1.4. to other persons – in cases provided by law.

6.2. The User’s Personal Data is provided to European Union Member States or other foreign countries under the same conditions and procedure as to Personal Data recipients in the Republic of Lithuania, and only for the purposes specified in this Privacy Policy and the legal acts of the Republic of Lithuania.

6.2.1. The User agrees that digioptima.eu, in order to protect its Users from fraud, identity theft, and other violations, will collect data about Users’ behavior, including, but not limited to, whether a person violates digioptima.eu general rules and other mandatory rules of the Website, and based on such collected data, will create a “blacklist”. This “blacklist” is used to protect other Website Users, whose correspondence is analyzed by an automatic system looking for data from the “blacklist”, and in other prevention cases.

6.2.2 The User has the right to disagree that his personal data be processed for the purpose specified in point

6.2.3 of these rules. The User must submit a written notification to digioptima.eu about the disagreement regarding the processing of personal data for the above-mentioned purpose. If the User’s disagreement is legally justified, digioptima.eu will immediately and free of charge cease the processing of personal data, except in cases provided by law.

7. PROTECTION OF PERSONAL DATA

7.1. The Website Administrator will make all reasonable efforts using internal organizational and technical measures to ensure that the User’s Personal Data provided are protected from any illegal actions: illegal alteration, disclosure, or destruction of Personal Data, identity theft, fraud, and that the level of Personal Data protection complies with the requirements of the legal acts of the Republic of Lithuania.

7.2. The User undertakes and must protect his password and username for logging into the Website, as well as other data. The User undertakes and must not disclose Personal Data about himself or third parties to any other third parties if such third parties’ Personal Data became accessible to him, and immediately inform digioptima.eu about visible violations.

7.3. Digioptima.eu is not responsible if the User’s personal data is illegally altered, disclosed, destroyed, the User’s identity is stolen, or otherwise fraudulently used using the User’s provided personal data, due to the User’s own fault or negligence, which arose as a consequence of non-compliance with the Privacy Policy, digioptima.eu general rules, or other Website rules, or legal acts, as well as due to any third parties’ actions. 7.4 Digioptima.eu may use personal data for direct marketing purposes: to send newsletters, general and personal offers, or other information that the user may be interested in. The User can withdraw his non-objection/consent to use his data for digioptima.eu direct marketing purposes at any time. To opt-out of all provided digital communication, this can be done by writing an email to info@digioptima.eu or by pressing the “opt-out”/”unsubscribe” link at the bottom of the unwanted email. In this case, the user is immediately removed from the direct marketing notification recipient database.
